Posted by Jeff Ray May 3, 2004 12:34 PM Forgive me if I'm wrong, but I thought the statutory rape laws were designed with the thought that under a certain age, children are unable to give informed consent to anything (so goes the theory anyway). Consensual sex, therefore, with someone under the age, is legally impossible (under age to give consent means no consent is given even if the "victim" consented). As for the argument kdog puts forth about same school or peer exceptions, I'm not sure what legal/ethical basis there could be for that. I think it quite clear that the unduly harsh punishment was a function of race and race alone. However, to say that the case of statutory rape should have been dismissed because "usually this sort of thing is ignored" has no legal merit. |
