Depending on the juridiction, a statute will require the government to show that the proscribed action was undertaken "intentionally" or "knowingly" or "willfully" or "recklessly." And yes, this gets incredibly technical. TalkLeft is not only for arguing whether a person's actions fit within the prohibitions of the law in question, but also whether a change in the law might be warranted. This is why kdog shouldn't be taken to task for suggesting a change, though obviously you could poke holes in it (consent isn't fungible in a K-12 school, for example, and though I'm sure s/he didn't have that in mind, it is a foreseeable argument). |
