The 18 year old scenario you describe should be a case by case basis, but once you start allowing discretion you start allowing discrimination or at least the appearance of discrimination. So tell me how do you do it without the law of unintended consequences kicking in? My idea would be something akin to a separate penalty phase like they do in death cases, A jury would have to agree (Maybe only a majority of jurors) that the person needed to register. |
