Terry Ruckriegle, the Judge presiding over the Kobe Bryant trial, took his head out of his proverbial buttocks today. He rejected the Bryant defense team argument that the Colorado Rape Shield statute is unconstitutional. For those who don't know, C.R.S. § 18-3-407 (Rape Shield) provides that, with certain exceptions, evidence of an alleged sexual assault victim’s sexual history “shall be presumed irrelevant” in court.
