I understand being cautious for the reason of protecting potential future victims but judges should be able to look at these cases on safety hazards an individual basis and give sentences based on the facts rather than the required sentence. No one wants to see a child hurt in that or any manner but something needs to change to protect 18 yr olds that are with their peers. That is the safety hazards problem, each case has to be dealt with individually. Unfortunately they can't safety hazards write the laws that way and everyone gets treated the same regardless of circumstance, like your brother. My brother has a similar story only his stems not from sex or sexual behavior but an accidental "brushing" of his step daughters breast while they were wrestling and tickling each other one day in plain sight of his wife and two other children.
